Reasonable Adjustment ? Options

I have read that some organisations have the option to extend full paid sick leave in certain circumstances. Have any members applied for this as a “reasonable adjustment” under the DDA ? I am currently on full pay but this stops in the middle of August, and am awaiting my appointment with the OHP. I know in life if you don’t ask, you’ll never know, but am still a little reluctant at this stage. Any suggestions ???? Blink Blink

Hiya Jackie ,

Employment is not my main subject and it might be an idea to telephone the NRAS helpline.

There is more general Information HERE

Firstly, you need to look at both your Terms and Conditions of Employment(T&C's), and your Company Sickness Policy to see if an extension is an option for anyone, or whether it could be discretionary.
If you seek advice elsewhere you would likely need this information in any case.

Have a look at the NRAS leaflet HERE about the Equality Act... this has a few numbers on it to call , Namely ACAS, European Human Rights Commission (EHRC) and the Disability Law Service.

If you will have been on Company Sick Pay for six months (28 weeks) in August, you will have to claim Employment and Support Allowance. Your company should be sending you an SSP1 form to enable you to do this, and they should be sending this to you about now.
If , when your CSP stops , you have been off work for less than 28 weeks , then you will still get SSP for the remainder of that time , and could be entitled to Working Tax Credits if your family income is below certain thresholds.

Personally .. i would look at the T&C's of your employment and Sick Policy and then phone HR (or whoever deals with HR issues) and ask whether there is a possibility of an extension ( without mentioning Reasonable Adjustments or the Equality Act) .If August will be 28 weeks on Sick pay then ask for your SSP1 form.


Definitely seek one to one advice though .

I find it of great concern that there seem to be many members who have employment problems which should be addressed through the Helpline. In the past, many members were referred to me to assist via the Helpline as Employment Law was my occupation before ill-health retirement forced me to lay down my pen. Sadly, there have been to referrals for many months - despite the fact that I didn't claim for cost of calls when working on the Helpline!

I agree Bob ...
hence my first comment on my post stating call the NRAS helpline .

My main concern and expertise was with regard the SSP and probability of having to claim ESA.It is also surprising that people don't realise they can get working tax credits while on SSP, and use their previous hours as the qualifying hours requirement, and using the ssp as income rather than their previous wages.

Most new members would not know you existed as a resource , and in fact i didn't for the first 6 months of forum use, and wasn't sure you were still available .

But ..extremely glad you are :).
There are lots of employment issues on here at the moment and it is very worrying that if you lose a job through illness, or the effects of illness and claim ESA then you will most likely still be expected to make efforts to make yourself employable .

Anyway good to see you about.. hope all is as good as it can be with you and i expect you will now be receiving a lot of calls :)

Roberto, old son - how good to see you on here, albeit that you look like an escaped convict in your photo!! The Bob I remember was a suave, handsome chap - and flattery will get me no-where! xx
